Notification of the Imposition of Conditions of Entry for Certain=20
Vessels Arriving to the United States; Venezuela

AGENCY: Coast Guard, DHS.

ACTION: Notice.

SUMMARY: The Coast Guard announces that it will impose conditions of=20
entry on vessels arriving from the country of Venezuela.

DATES: The policy announced in this notice will become effective=20
January 23, 2009.

SUPPLEMENTARY INFORMATION:

Background and Purpose

    Section 70110 of the Maritime Transportation Security Act of 2002=20
(Pub. L. 107-295, Nov. 25, 2002) (46 U.S.C. 70110) provides that the=20
Secretary of Homeland Security may impose conditions of entry on=20
vessels requesting entry into the United States arriving from ports=20
that are not maintaining effective anti-terrorism measures. The Coast=20
Guard has been delegated the authority by the Secretary to carry out=20
the provisions of this section. Previous notices have imposed or=20
removed conditions of entry on vessels arriving from certain countries=20
and those conditions of entry and the countries they pertain to remain=20
in effect unless modified by this notice.
    The Coast Guard has determined that ports in Venezuela are not=20
maintaining effective anti-terrorism measures. Accordingly, effective=20
January 23, 2009 the Coast Guard will impose the following conditions=20
of entry on vessels

that visited ports in Venezuela during their last five port calls.=20
Vessels must:
    <BULLET> Implement measures per the ship's security plan equivalent=20
to Security level 2 while in a port in the above country;
    <BULLET> Ensure that each access point to the ship is guarded and=20
that the guards have total visibility of the exterior (both landside=20
and waterside) of the vessel while the vessel is in ports in the above=20
country. Guards may be provided by the ship's crew, however, additional=20
crewmembers should be placed on the ship if necessary to ensure that=20
limits on maximum hours of work are not exceeded and/or minimum hours=20
of rest are met, or provided by outside security forces approved by the=20
ship's master and Company Security Officer;
    <BULLET> Attempt to execute a Declaration of Security while in a=20
port in the above country;
    <BULLET> Log all security actions in the ship's log;
    <BULLET> Report actions taken to the cognizant U.S. Coast Guard=20
Captain of the Port prior to arrival into U.S. waters; and
    <BULLET> Based on the findings of the Coast Guard boarding or=20
examination, vessels may be required to ensure that each access point=20
to the ship is guarded by armed private security guards and that they=20
have total visibility of the exterior (both landside and waterside) of=20
the vessel while in U.S. ports. The number and position of the guards=20
has to be acceptable to the cognizant Coast Guard Captain of the Port=20
prior to the vessel's arrival.
