45' Main Channel Deepening Project

The highest priority for all Delaware River users and stakeholders, as it directly relates to our region’s future growth, is the deepening of the Delaware River main channel to 45’.  With newer ships requiring a deeper channel, the Exchange works with other port agencies, businesses and labor to support this project regionally and in Washington, D.C.

Recent History

In July 2009. the COE issued a Request for Proposals stating its intent to commence construction on the deepening project, beginning in the New Castle Range, which lies within the boundaries of the State of Delaware.  On July 24, Delaware Department of Natural Resources and Environmental Control (DNREC) Secretary Collin O’Mara signed an order denying the COE’s permit application in that state, citing substantial changes in the scale of the project since the COE’s original 2001 application.  It should be noted that the order specifically states that the denial was based on process and not on the merits of the project.  In response, the COE stated that the permit was requested in good faith and cooperation and was not an absolute requirement to begin the project.

In October 2009, Delaware Attorney General Beau Biden filed suit in the U.S. District Court for Delaware to block the COE, who asserts that federal authority preempts state permitting authority, from beginning the project.  In New Jersey, former Governor Jon Corzine directed his Attorney General to take legal action to block the project from moving forward, as well. 

On December 8, U.S. District Court Judge Sue L. Robinson presided over a federal court hearing on Delaware's bid for a preliminary injunction in this matter.  Judge Robinson stated she would accept written comments from interested parties on both sides of the issue through December 22.

On January 27, 2010, U.S. District Court Judge Sue L. Robinson rendered a decision denying the State of Delaware’s motion for an injunction to block the United States Army Corps of Engineers from executing a contract to initiate the Delaware River Main Channel Deepening (45’) Project.
